Most people would see no direct change from this bill. It orders a yearly study of how much competition there is in health care in each state. The study would run for 10 years. Each year, the results would go to Congress and be posted online. The data would be public and easy to search. The study would track how states license doctors, nurses, and other health workers. It would track mergers and buyouts of hospitals, clinics, insurers, and telehealth firms. It would count state laws that limit new health care buildings ("certificates of need"). It would also count state laws that approve hospital mergers ("certificates of public advantage"). It would look at whether people can buy short-term health plans or association health plans. An office inside the Department of Health and Human Services would run the study. Antitrust officials at the Federal Trade Commission and the Justice Department would advise it.

Measuring State Healthcare Freedom Act This bill temporarily requires studies on health care competition and consolidation at the state level, including collecting information on topics such as licensing of health care professionals and mergers and acquisitions of health care entities (e.g., hospitals and health insurance companies). For 10 years after the bill's enactment, the Office of the Assistant Secretary for Planning and Evaluation within the Department of Health and Human Services must annually carry out the studies and report to Congress. The office must consult with the Antitrust Division of the Department of Justice and the Federal Trade Commission on the studies.
