Jamie Reed Protecting Our Kids from Child Abuse Act

YourVoice.Now 摘要

你的钱公民自由

People who had gender-transition care as minors could sue clinics, doctors, hospitals, and colleges until age 48.

你的钱

Federal money for minors' gender treatments — banned

No federal money could pay for puberty blockers, hormones, or surgery to change the body of anyone under 18. The ban leaves out care for kids born with unclear sex traits. It also leaves out care needed to prevent death or serious harm.

公民自由

Right to sue over youth gender treatments — until age 48

A person treated as a minor could sue in federal or state court until 30 years after turning 18. The harm can be to body or mind and only has to come partly from the treatment.

Protection from suits for all gender-clinic providers — not just treating doctors

Any licensed provider who worked at the clinic at the time could be sued, not just the one who gave the care. So could a hospital or college tied to the clinic.

Protection from suits over past care — reaches back in time

The new right to sue covers treatments given before the bill became law. Clinics and doctors could be sued for care they gave years earlier.

关于本法案的更多内容

If you got puberty blockers, hormones, or surgery for gender transition before age 18, you could sue over later harm. You would have until 30 years after your 18th birthday, which is age 48. The harm could be to your body or your mental health. It would only have to come in part from the treatment. You could ask for money for your losses, extra money meant to punish (punitive damages), and your lawyer's fees. The rule would also reach treatments given before the bill became law. Many people and places could be sued. That includes the gender clinic for minors and the doctor who gave the treatment. It also includes any licensed provider who worked at that clinic at the time. Any hospital or public or nonprofit college that runs, hosts, funds, or partners with the clinic could be sued too. A clinic or doctor would have a defense if they had no reason to know the patient was a minor. Some care falls outside the bill. That includes care for people born with unclear sex traits and care for harm from an earlier procedure. It also includes care needed to prevent death or serious harm. The bill would also block all federal money to these clinics. The same ban would apply to any hospital or college tied to one. No federal money could pay for these treatments for anyone under 18.

国会摘要

Jamie Reed Protecting Our Kids from Child Abuse Act This bill makes certain health care facilities and medical practitioners liable for any physical or mental harm caused by performing a gender-transition procedure on an individual younger than age 18. The liability extends for 30 years after the individual who received the procedure turns 18, and it applies to procedures occurring before, on, or after the bill's date of enactment. Specifically, the liability applies to pediatric gender clinics (medical facilities specializing in the diagnosis and treatment of gender discordance and dysphoria in minors) that provide gender-transition procedures; institutions of higher education and hospitals affiliated with those clinics, and medical practitioners who perform gender-transition procedures or administer health care related to the procedures at pediatric gender clinics. Medical practitioners and health care facilities may defend against a liability claim if they neither knew nor had reason to know the individual was a minor. Additionally, the bill prohibits federal funding for (1) gender-transition procedures performed on minors, (2) pediatric gender clinics, and (3) institutions of higher education or hospitals affiliated with those clinics. Under the bill, gender-transition procedures generally include surgeries or hormone therapies that change the body of an individual to correspond to a sex that is different than the individual's biological sex. These exclude, however, specified types of interventions, including those that address (1) ambiguous biological sex characteristics or abnormal sex chromosome structure or hormones; or (2) infections or other harms that result from a gender-transition procedure.
