Cooper Davis and Devin Norring Act

YourVoice.Now 摘要

公民自由刑事司法与正当程序透明度与问责制

Apps, email, and cloud services would have to report fentanyl, meth, and fake-pill sales they find — or face fines up to $380,000.

公民自由

Police posing as users to tip companies — banned, evidence excluded

Police may not send a report to a company, or ask someone else to send one for them. Any evidence from a company report started that way cannot be used in court.

Your app messages — can go to federal agents without a warrant

Federal privacy law limits when firms may give your messages and account records to the government. This bill adds an exception for these drug reports. A report may include your messages, photos, and where you are. The Justice Department may share it with state and local police.

Notice your account data was saved — delayed at least 45 workdays

Each report makes the company save your account data for 90 days. The company cannot tell you until it warns the Justice Department and then waits 45 business days.

刑事司法与正当程序

Reports of online drug sales — sent to Justice Department within 60 days

Social media, email, and cloud firms must report sales of fentanyl, meth, or fake pills once they know of them. Illegal sales of pain pills or stimulants count too. They may also report a sale they only suspect.

Fines for platforms that don't report — up to $380,000

A company that knowingly skips a required report can be fined up to $190,000, or $380,000 for repeat failures. A false report, or one missing account details the company has, brings a civil fine of $50,000 to $100,000.

透明度与问责制

Yearly public count of drug-sale reports — from Justice Department

Within a year, the Justice Department must start posting yearly counts. They show reports per company, how many led to a conviction, and how many had no useful leads.

关于本法案的更多内容

Apps and websites you use would have to report drug sales they find to the Justice Department. This covers social media, email, and cloud storage companies. They must report sales of fentanyl or meth once they actually know about them. The same goes for fake pills and illegal sales of prescription painkillers or stimulants. Each report is due within 60 days of the company finding out. A company may also report a sale it only suspects. A report must include account details, such as your name, email, screen name, and IP address (your internet location). The company may also choose to send your messages, photos, location, and whether you used a VPN. Federal privacy law now limits when companies may share your messages with the government. This bill adds an exception for these reports. The Justice Department may pass reports on to federal, state, or local police. Regular phone texts and home internet service are not covered. Companies do not have to scan your messages, and they can keep using end-to-end encryption. A company that knowingly fails to report faces a fine of up to $190,000. Repeat failures cost up to $380,000. A false report, or one missing account details the company has, costs $50,000 to $100,000. Each report makes the company save your account data for 90 days. The company cannot tell you about this until it warns the Justice Department and waits 45 business days. Police may not send tips to companies to set off a report. Evidence from such tips cannot be used in court. The Justice Department must delete reports it no longer needs and publish a yearly count of them.
