Max prison for gun-business theft — 20 years, up from 10

Stealing a gun from the stock of a licensed dealer, maker, or importer is a federal crime with up to 10 years in prison today. The bill raises the top term to 20 years.

Mandatory minimum for gun-business burglary or robbery — 3 or 5 years

If the gun theft happens during a break-in at the business, the judge must give at least 3 years. If it happens during a robbery, the floor is 5 years.

Attempted gun thefts from licensed sellers — same penalties as theft

Today these theft rules cover only a gun that is really stolen. Under the bill, a failed try would get the same penalty. That goes for thefts from gun shops, makers, importers, and collectors.

关于本法案的更多内容

If someone steals a gun from a licensed gun dealer, maker, or importer, the top federal prison term would double. It would go from 10 years to 20. A failed try would face the same penalty. If the theft happens during a break-in, the judge would have to give at least 3 years in prison. If it happens during a robbery, the minimum would be 5 years. Most people would see no change in daily life. The bill defines a break-in as unlawfully entering or staying in the business to commit a crime. A separate rule already punishes stealing a gun from any licensed gun business or collector with up to 10 years. Failed tries would now be covered by that rule too. The bill also drops a line in current law saying this federal crime does not replace state laws on the same subject.

国会摘要

Federal Firearms Licensee Protection Act of 2026 This bill modifies criminal penalties for an offense involving the theft of a firearm from a licensed importer, manufacturer, or dealer, or from their business premises. Specifically, the bill does the following: increases from 10 to 20 years the maximum prison term, and creates a 3- or 5-year mandatory minimum prison term for an offense that occurs during the commission of a burglary or robbery. An attempt to commit an offense is subject to the same penalties as a substantive offense.
