YourVoice.Now Summary
Corporate BenefitsCivil LibertiesPeople hurt by a COVID-19 vaccine could sue the maker — even for past shots, and even after getting federal injury pay.
Corporate Benefits
No federal law could protect COVID-19 vaccine makers from lawsuits or limit what they owe for injuries. This applies to shots given before or after the bill becomes law. Doctors, pharmacists, and shippers keep any protection they have now.
Civil Liberties
People who say a COVID-19 vaccine hurt them could take the maker to court. Today, in a declared emergency, the main path is a federal payment fund. Suits are allowed only for willful misconduct.
Today, if you take money from the emergency injury fund, you give up the right to sue. Asking for or taking money from either fund would no longer stop a suit against the maker.
More about this bill
If a COVID-19 vaccine injured you, you could sue the company that made it. No federal law could shield COVID-19 vaccine makers from these lawsuits or cap what they owe. Today one federal law can protect makers during a declared health emergency. Under it, the only exception is a willful misconduct claim for death or serious injury. The change would also cover shots given before the bill becomes law. You could still ask for payment from either federal vaccine-injury program. Getting money from one would no longer stop you from also suing. Today, accepting payment from the emergency program means giving up the right to sue. The change covers vaccine makers only, not the doctors, pharmacists, or shippers who gave or moved the shots.
Congressional Summary
Let Injured Americans Be Legally Empowered Act or the LIABLE Act This bill prohibits COVID-19 vaccine manufacturers from being immune under federal law from lawsuits relating to their vaccines. Specifically, the bill prohibits any federal law from providing immunity for COVID-19 vaccine manufacturers from civil suits or liability, or limiting liability, with respect to the administration or use of their vaccines. Additionally, individuals may not be precluded from bringing a civil suit against a COVID-19 vaccine manufacturer because the individual sought or received compensation through specified federal vaccine injury compensation programs, nor does the bill preclude individuals from seeking compensation through these programs. The bill applies to vaccine administrations that occur before, on, or after the bill's date of enactment.
