The details
Medicare, Medicaid, and private health plans could no longer pay for certain organ transplants. The ban covers transplants performed in China. It also covers any transplant using an organ not obtained through the U.S. national donor network. Follow-up care tied to those transplants would not be covered either. The one exception is care needed to save the patient's life afterward. Providers who knowingly perform a banned transplant could face fines and up to two years in prison. Federal or state attorneys general could also sue for three times the cost of the procedure. The rules would start January 1, 2026. Health and Human Services must issue rules identifying the covered items and services by that date.

Block Organ Transplant Purchases from China Act of 2025 or the Block Act of 2025This bill prohibits Medicare, Medicaid, and private health insurers from covering organ transplants that occur in China or that involve organs that are not procured through the U.S. Organ Procurement and Transplantation Network.The bill also prohibits health care providers from performing such a transplant or related services, except for life-saving services that are necessary as a result of such a transplant. Violations are subject to criminal and civil penalties.
