End Judge Shopping Act

YourVoice.Now Summary

Civil Liberties

Lawsuits seeking a nationwide court order could only be filed where two or more judges sit.

Civil Liberties

Where nationwide court-order lawsuits can be filed — two-judge divisions only

Cases asking for a court order that covers the whole country would have to start in a court division with at least two active judges. People suing could no longer file in a one-judge division where they know who will hear the case.

More about this bill

Most people would not notice this change. It matters to people and groups who sue to block a policy across the whole country. Some lawsuits ask a judge for an order that applies everywhere, not just to the people in the case. Under this bill, those cases could only be filed in a federal court division with two or more active judges. Today, some court divisions have only one active judge. A person who files there can know ahead of time which judge will hear the case. The bill's name calls this "judge shopping." The bill does not limit what a judge may order. It only changes where these cases can be filed. It covers any such case, no matter who files it.
