Civil Liberties
States whose laws let a person sue for damages when a partner removes a condom or other barrier without consent would get a bigger federal grant. The bill does not create that right itself; each state decides.
More about this bill
A state could get more federal money for sexual assault victims if its law allows one kind of lawsuit. That suit is against a partner who removes a condom during sex without consent. The Justice Department would have to raise that state's grant from its Sexual Assault Services Program. That program funds rape crisis centers and other victim services. The raise could be up to 20% of the state's average award over its last three grants. Each raise lasts four years. A state can get one no more than four times. To qualify, a state must apply and describe its law. Congress could spend $5 million a year on this from 2026 through 2030. No state would have to pass such a law. Covered barriers include condoms, internal condoms, dental dams, and similar protection.
Congressional Summary
Consent is Key Act This bill directs the Department of Justice to increase a state's allocation of funds under the Sexual Assault Services Program if the state has in effect a law that authorizes civil damages and equitable relief against a person who engages in the nonconsensual removal of a sexual protection barrier (e.g., a condom).
