Direct sellers and qualified real estate agents would be written out of the definition of "employee" in federal wage law. The Fair Labor Standards Act is the law that sets the federal minimum wage, the 40-hour overtime threshold, and employer recordkeeping duties. Workers outside its definition of employee are not covered by any of it. Tax law already treats these two groups as non-employees under Internal Revenue Code section 3508. The bill borrows that same definition and applies it to wage law. For the roughly two million people who sell real estate or sell products person-to-person, it would settle their federal status as independent contractors. It would also close off federal minimum-wage and overtime claims against the companies and brokerages they work through.

Direct Seller and Real Estate Agent Harmonization ActThis bill excludes a real estate agent or a direct seller of consumer products from the definition of an employee for the purpose of applying the Fair Labor Standards Act of 1938 (FLSA). Workers who are considered employees under the FLSA must be paid the minimum wage and are generally eligible to receive overtime compensation for hours worked in excess of a 40-hour workweek.
