Enhancing Geothermal Production on Federal Lands Act

YourVoice.Now Summary

Environment

Small geothermal test wells on leased federal land could skip a full federal environmental study.

Environment

Environmental review for geothermal test wells — skipped on leased land

Under the main federal law on the environment, a big federal action needs a detailed study first. A leaseholder's small test wells would not count as one. They must stay under 8 acres and be done in 180 days.

Environmental review for geothermal road work — skipped inside rights-of-way

Driving off-road and building, fixing, or rerouting existing access roads would also skip that study if the work stays in an approved right-of-way. So would soil and rock testing. This covers looking for, building out, or producing geothermal energy.

More about this bill

Companies that lease federal land to tap underground heat could drill small test wells without a full federal environmental study. Today, a major federal action that could badly affect the environment needs a detailed study of its effects. These test wells would no longer count as one. To qualify, a project must disturb less than 8 acres at a time, not counting roads. It must be done within 180 days. The land must be restored within 3 years, unless the lease moves on to producing energy. Some other work tied to geothermal energy would skip that study too. That includes soil and rock testing, driving off-road, and fixing or rerouting existing access roads. The driving and road work must stay inside approved rights-of-way (strips of land set aside for roads or lines). The leaseholder must tell the Interior Department 30 days before drilling starts. Most households would see no direct change.

Congressional Summary

Enhancing Geothermal Production on Federal Lands Act This bill exempts certain projects and activities related to geothermal development on federal land from environmental review requirements. Specifically, the bill exempts certain geothermal exploration projects with limited impact on federal land from environmental review under the National Environmental Policy Act of 1969 (NEPA). Geothermal exploration projects are those that involve the drilling of geothermal exploratory wells, such as temperature gradient wells, monitoring wells, or calibration wells, and that are limited in size, duration, and other aspects in accordance with specified criteria. The bill also exempts from NEPA the following activities related to the exploration, development, or production of geothermal resources: (1) geotechnical investigations; (2) off-road travel in certain existing rights-of-way; and (3) the construction, maintenance, realignment, and repair of access roads within such rights-of-way.
