Fair Credit Reporting Reseller Accuracy Act

YourVoice.Now Summary

Corporate BenefitsTransparency & AccountabilityYour Money

Credit-file middlemen would owe you a written accuracy duty — but could not be sued when they pass a bureau's error along word for word.

Corporate Benefits

Legal shield for firms that resell your credit file

Resellers include tenant screening firms, background check firms, and mortgage credit reporting firms. Today a narrow protection exists only inside the dispute-handling rules. The new shield would run to the whole Fair Credit Reporting Act, wherever a reseller accurately relayed what another agency supplied.

Transparency & Accountability

Written duty on resellers to keep your file accurate

Resellers would be told in the statute to follow reasonable procedures for maximum possible accuracy before sending a file out. Courts already treat resellers as credit reporting agencies bound by that same standard, so this makes the wording plain more than it raises the bar.

Accountability of resellers for errors they pass along

The new text says no reseller may be held liable under the credit reporting law if it accurately communicates information obtained from another agency. Today a consumer can argue the reseller itself should have had procedures that caught the error before selling the file on.

Your Money

What you could recover when a resold report is wrong

Damages, set penalties, and legal fees under the credit reporting law are how people are paid back for a bad report. Where the error came from the bureau and was relayed unchanged, that money would have to come from the bureau instead of the middleman.

More about this bill

Companies that resell your credit file to others would gain a legal shield. A reseller is a middleman. It buys your file from a big credit bureau, packages it, and sells it on to a landlord, a lender, or an employer. Under this change, a reseller would have to take reasonable steps to keep that file as accurate as possible. That duty would be written into the credit reporting law for the first time. The second half points the other way. A reseller could not be held liable under that law if it passed on, word for word, what the bureau gave it. Bad data that starts at the bureau would be the bureau's problem alone. So if you lost an apartment or a loan over a wrong resold report, your claim against the middleman would be much harder to bring. The shield covers the whole credit reporting law, not just one part of it.
