Disability and Age in Jury Service Nondiscrimination Act

YourVoice.Now Summary

Civil Liberties

Federal courts could not keep people off juries over their age, or over a disability that reasonable help can work around.

Civil Liberties

Disabled people's right to serve on federal juries — with accommodations

Disability would join the list of reasons a court may not use to keep you off a federal jury. A court could turn you away for a disability only if reasonable help could not let you serve. That includes help to meet the English rules.

Protection from age-based exclusion from juries — federal courts only

Federal law already bans keeping people off juries over race, color, religion, sex, national origin, or money. Age would be added to that list. Jurors must still be at least 18.

More about this bill

If you have a disability, a federal court could not keep you off a jury for that reason if reasonable help would let you serve. Courts also could not keep people off federal juries because of their age. Today, the law already bans this over race, color, religion, sex, national origin, or how much money someone has. Disability and age would join that list. Today, a court can turn away someone whose mind or body keeps them from serving well. That rule would cover only a disability that reasonable help cannot work around. Jurors must be able to read, write, and speak English. A person who can't because of a disability could still serve if help lets them meet the rule. The rule that jurors be at least 18 would stay.
