The details
Nobody knows exactly how many federal crimes exist. The Justice Department would have to count them and publish the list. The report would name every federal criminal offense and spell out its elements. For each one it would give the potential penalty and the mental state prosecutors must prove. It would also show how many people the department charged each year over the past 15 years. Thirty-five agencies would do the same for crimes created by regulation rather than by statute. That list runs from the EPA and the SEC to the Nuclear Regulatory Commission and the FTC. Each agency would report penalties, mental-state requirements, and referrals to prosecutors. Within two years, all of it would go into free public indexes online. No money is authorized to do the work.
