Transparency & Accountability
- Pay-withholding rule for Senators — Compensation held during any lapse in appropriations
- Timing of Senators' pay — Delayed until after a shutdown ends, with the full amount still released
The details
This resolution holds back Senators' paychecks whenever the government shuts down. A shutdown here means a lapse in funding for one or more federal agencies or departments. During any such lapse, the Secretary of the Senate would hold the pay that each Senator would otherwise receive for that period. The money is withheld, not forfeited. As soon as practicable after the shutdown ends, the Secretary releases everything that was held. The rule binds only the Senate, so House members are not covered. It takes effect the day after the November 2026 general election, because the Constitution bars changing sitting members' pay mid-term. The Senate agreed to the resolution on May 14, 2026.
Congressional Summary
This resolution withholds compensation from Senators during any federal government shutdown (i.e., lapse in appropriations for one or more federal agencies or departments). Senators are to be paid as soon as practicable after the date on which the government shutdown ends. The restriction applies beginning on the day after the regularly scheduled general election for federal office held in November 2026. (As background, the U.S. Constitution provides that legislation varying the level of compensation paid to members of Congress may not take effect until an intervening election has occurred.)
