Ending Forced Arbitration of Race Discrimination Act of 2025

Buod ng YourVoice.Now

Kalayaang SibilMga Benepisyo sa Korporasyon

You could take a race, color, or national origin bias claim to court — even if you signed an arbitration agreement.

Kalayaang Sibil

Court access for race bias claims — arbitration clauses can't block it

If you claim bias based on race, color, or national origin, you could choose to go to court. An arbitration agreement signed before the problem began could not stop you.

Group lawsuits over race bias — signed class-action waivers won't hold

A signed promise not to join a group, class, or joint case would not hold for these claims. You could team up with others who faced the same treatment.

Judge decides if these rules apply — not the arbitrator

A court, not an arbitrator, would decide whether a case is covered. That holds even if the contract hands that choice to an arbitrator.

Mga Benepisyo sa Korporasyon

Companies' right to enforce arbitration deals — not for race bias claims

A company could not hold you to an arbitration deal signed in advance for a race, color, or national origin bias claim. This also covers deals under international arbitration treaties. It applies only to claims that come up after the bill becomes law.

Higit pa tungkol sa panukalang ito

If you claim you faced bias because of your race, color, or national origin, you could take your case to court. That would hold even if you signed an arbitration agreement before the problem began. Arbitration is a private process that takes the place of a public trial. The choice would be yours, not the other side's. You could also join a group or class-action case, even if you signed away that right. The rules cover unfair treatment, harassment, and payback tied to race, color, or national origin. The claim can be under federal, state, tribal, or local law. A judge, not an arbitrator, would decide if a case is covered. That holds even if the contract says an arbitrator decides. The rules would apply only to claims that come up after the bill becomes law.
